Privacy policy

This policy explains how MINJAY (Jayesh Mitha), based in Cape Town, South Africa, collects, uses and protects your personal information when you use this website, contact me or book a ceremony. It is written to comply with the Protection of Personal Information Act 4 of 2013 (POPIA).

Who is responsible for your information

The responsible party and Information Officer is Jayesh Mitha (MINJAY), Cape Town, South Africa. You can reach me at info@minjay.co.za for any privacy question or request.

What information is collected

  • When you contact me (email, WhatsApp or phone): your name, contact details and whatever you choose to share.
  • When you complete the participation form: your name, email, mobile number, date of birth, emergency contact, how you heard about me, the ceremony you choose, your previous experience with plant medicine, medication, health screening answers (including physical and mental health and pregnancy), food allergies, special requirements and intentions, and your consent.
  • Technical information: like any website, the hosting provider records standard server logs (such as IP address, browser type and pages requested) for security and reliability.
  • Website analytics: anonymous, cookieless visit statistics (such as pages viewed, referring site and country) are measured with Ahrefs Web Analytics to understand how the site is used. No cookies are set and you are not identified personally. This site does not use advertising or tracking cookies.

Health information is special personal information under POPIA. It is collected only with your explicit consent, and only to assess whether it is safe for you to participate and to support your wellbeing during and after ceremony.

How your information is used

  • To respond to your enquiries.
  • To assess your eligibility and safety before a ceremony, and to care for you during and after it.
  • To confirm your booking, payment reference and preparation guidance.
  • To contact your emergency contact if there is a genuine emergency.
  • To keep the records needed to run ceremonies responsibly.

Your information is never sold, and is never used for marketing without your permission.

Who your information is shared with

Your information is shared only with the service providers needed to operate this website and booking process, each of whom is required to keep it secure:

  • SpiritTeam — the booking system that stores participation forms and ceremony registrations.
  • Email delivery — a transactional email provider used to send me a copy of each participation form.
  • Website hosting — the provider that hosts and serves this website.
  • Ahrefs — cookieless website analytics.

Some providers may store data outside South Africa. Where this happens, it is only with providers that offer adequate protection, as POPIA requires. Information may also be disclosed if required by law.

Third-party content

  • YouTube videos on the music page load only when you press play, using YouTube’s privacy-enhanced mode. Once playing, YouTube’s own privacy policy applies.
  • Links to Instagram, YouTube and WhatsApp take you to those services, which have their own privacy policies.

How long information is kept

Personal information is kept only as long as it is needed for the purposes above, or as long as the law requires. You may ask for your information to be deleted at any time, unless it must be kept for a legal reason.

How your information is protected

Reasonable technical and organisational measures are used to protect your information, including encrypted connections (HTTPS), restricted access to participation forms and keeping secret keys out of the website code.

Your rights

Under POPIA you have the right to:

  • Ask what personal information is held about you and request a copy.
  • Ask for incorrect information to be corrected, or for information to be deleted.
  • Object to processing, or withdraw your consent at any time.
  • Lodge a complaint with the Information Regulator (South Africa) — inforegulator.org.za.

To make a request, email info@minjay.co.za.
